Planned Parenthood: Fact v. Fiction

Claim:

The undercover videos show Planned Parenthood trafficking in fetal tissue for profit in violation of federal law.

  • Planned Parenthood engages in the “illegal sale of aborted baby parts.”[1]
  • Planned Parenthood engages in “selling baby parts.”[2]

Facts:

The videos include no credible evidence that Planned Parenthood profits from its fetal tissue donation program.

  • Despite Daleiden’s three-year effort to entrap Planned Parenthood, he “failed to succeed in convincing even a single affiliate to enter into a procurement contract with his fake company.”[3]
  • Daleiden offered one Planned Parenthood affiliate $1,600 for two specimens—more than 25 times the amount of expenses affiliates typically recoup—but the affiliate never agreed.[4]
  • In another attempt to entrap a Planned Parenthood affiliate, Daleiden sent a proposed “transfer agreement” with a “compensation” clause. The affiliate removed that term and added: “Nothing in the Agreement is intended to provide valuable consideration in return for the transfer of the Samples.” Daleiden was “unresponsive” to these revisions and dropped the effort.[5]

Claim:

Planned Parenthood is paid for fetal tissue donations in violation of federal law.

  • “Planned Parenthood is still receiving $50, $75, sometimes $100 per specimen per fetal part. So all of that is just straight up profit that goes to their bottom line.”[6]

Facts:

Planned Parenthood receives reasonable reimbursement for its tissue donation services, as expressly permitted by law.

  • Congress passed the NIH Revitalization Act in 1993 with overwhelming bipartisan support.[7]
  • This law prohibits the receipt of any “valuable consideration” for fetal tissue while expressly permitting “reasonable payments” for costs, including “transportation, implantation, processing, preservation, quality control, or storage of human fetal tissue.”[8]
  • Planned Parenthood affiliates that participate in fetal tissue research “recover only their costs, as allowed under the federal law and our [Planned Parenthood’s] guidance.”[9]
  • Currently, only two of Planned Parenthood’s 59 affiliates participate in fetal tissue research. One is reimbursed for reasonable costs at $60 per specimen, and the other receives no reimbursements.[10]
  • Tissue procurement companies confirm that they reimburse Planned Parenthood only for “reasonable costs,” including “processing, preservation, quality control, transportation, and storage.”[11]

Claim:

Planned Parenthood doctors change the method, timing, and procedure of abortions to obtain fetal tissue in violation of federal law.

  • “Planned Parenthood ‘changes the abortion procedure’ … Basically, they will use the abortion method that produces the most valuable baby parts for sale to scientists.”[12]

Facts:

There is no credible evidence that Planned Parenthood doctors change the method, timing, or procedure of abortions solely for the purpose of obtaining fetal tissue in violation of federal law.

  • Federal law requires physicians to certify that “no alteration of the timing, method, or procedures used to terminate the pregnancy was made solely for the purposes of obtaining the tissue” for federally funded fetal tissue transplantation research.[13]
  • HHS “has not funded or conducted this specific type of research in recent years.”[14] Nevertheless, Planned Parenthood has “included the substance of the federal requirements in our guidance.”[15]
  • The undercover videos include “no evidence that Planned Parenthood physicians altered the timing, method, or procedure of an abortion solely for the purpose of obtaining fetal tissue for research.”[16]
  • Planned Parenthood physicians may make “adjustments to the method as the surgery proceeds” to “achieve the woman’s desired result as safely as possible.” These adjustments are “clinical judgments—not a change of method.”[17]

Claim:

Planned Parenthood collects fetal tissue without obtaining proper consent in violation of federal law.

  • “If there was a higher gestation and the technicians needed it, there were times they would just take what they wanted and these mothers don’t know and there’s no way they would know.”[18]

Facts:

There is no credible evidence that Planned Parenthood collects fetal tissue without obtaining proper consent.

  • Before collecting fetal tissue for use in federally funded human fetal tissue transplantation research, federal law requires physicians to certify that “the consent of the woman for the abortion was obtained prior to requesting or obtaining consent for a donation of the tissue for use in such research.”[19]
  • Federally funded human fetal tissue transplantation research has not been conducted in the U.S. in recent years. Although not required to do so, Planned Parenthood has “voluntarily incorporated the informed consent requirements into its guidance.”[20]
  • Planned Parenthood affiliates that participate in fetal tissue research obtain informed consent for abortion from the patient “before she knows the gestational age of the fetus.” Only after providing consent for abortion is the patient “given the option for tissue donation.”[21]
  • Tissue procurement personnel are trained to obtain informed consent for tissue donation only “after the patient has consented to the abortion procedure.”[22]

Claim:

Planned Parenthood conducts partial birth abortions in violation of federal law.

  • “She went on to explicitly describe the three ways Planned Parenthood is breaking the law: First, ‘selling the body parts of babies and getting profit from them;’ second, ‘they’re using partial-birth abortions to do this;’ and third, ‘they’re manipulating the abortion procedure, without the woman’s consent or knowledge, in order to better harvest the organs of the babies they’re going to be killing.’”[23]

Facts:

Planned Parenthood does not conduct partial birth abortions.

  • The only method of surgical abortion available at Planned Parenthood clinics is “dilation and evacuation” abortion.[24]
  • The “fetus is not delivered intact” in this type of procedure, and “no Planned Parenthood physician would intentionally perform such a procedure because to do so would be illegal.”[25]
  • The Committee has obtained no credible evidence that “any physician employed by Planned Parenthood affiliates has performed an ‘intact’ dilation and evacuation (D&E) [abortion] to preserve fetal tissue for research.”[26]
  • References to “intactness” contained in the undercover videos refer to “the intactness of the tissue and specific organs,” not the intactness of the fetus. Any suggested reference to an intact fetus is “the result of deceptive editing” by the Center for Medical Progress.[27

Claim:

Daleiden has now publicly released the full, unedited videos.

  • “Fromthe very beginning when we put out a summary video of an undercover meeting, the full footage of that meeting is always released in conjunction with it.”[28]
  • “We are providing all raw data to law enforcement and Congressional investigators.”[29]

Facts:

The videos have been heavily edited and deceptively manipulated.

  • The first video released by Daleiden intentionally omitted ten instances in which Planned Parenthood’s Director of Medical Services, Dr. Deborah Nucatola, unequivocally stated that Planned Parenthood does not profit from tissue donations.[30]
  • At one point, Dr. Nucatola stated: “[N]obody should be ‘selling’ tissue. That’s just not the goal here.” That statement was edited out of the video.[31]
  • A forensic analysis of the so-called “full footage” videos found that they still contain “cuts, skips, missing tape, and changes in camera angle,” and “numerous intentional post-production edits.” The analysis found that one of the purported full-footage videos contains “more than 30 minutes of missing video.” [32]
  • The analysis concluded that the videos “cannot be relied upon for any official inquiries” and that even the underlying transcripts are “useless as ‘evidence’” because they contain “numerous errors, discrepancies, and omissions.”[33]

Claim:

Daleiden runs a non-profit biomedical organization.

  • “The Center for Medical Progressis a non-profit organization dedicated to informing and educating both the lay public and the scientific community about the latest advances in regenerative medicine cell-based therapies, and related disciplines.”[34]

Facts:

Daleiden created the Center for Medical Progress in 2013 with the sole purpose of entrapping Planned Parenthood.

  • Daleiden began working with anti-abortion extremist Troy Newman in 2012 on a plan to “infiltrate Planned Parenthood.” According to Newman, they planned to create “alternate identities” and “[a]lternate companies,” and they called themselves the Center for Medical Progress because “[i]t is one of these vague-sounding names, but it could mean many things.” [35]
  • In materials submitted with Daleiden’s 2013 application for 501(c)(3) tax-exempt status, the “[s]pecific purpose” of the Center for Medical Progress is described as follows: “to monitor and report on medical ethics and advances.”[36]
  • Daleiden listed on his application for tax-exempt status the Center’s website which described itself as “a non-profit organization dedicated to informing and educating both the lay public and the scientific community about the latest advances in regenerative medicine.”[37]
  • The IRS granted Daleiden’s request for tax-exempt status as a “bioengineering or biomedicine” charitable organization based on the misleading information he provided.[38]
  • Daleiden pledged in his application for tax-exempt status not to “attempt to influence legislation.” Accompanying materials stated that “[n]o substantial part of the activities of the corporation shall consist of carrying on propaganda, or otherwise attempting to influence legislation.”[39]
  • The Center is now engaged in a full-fledged lobbying effort to pass legislation to withhold federal funds from Planned Parenthood.[40]

Claim:

Daleiden’s activities were appropriate because he is an investigative journalist.

  • “The goal of this project—which was a two and a half year investigative journalism study—was to really clearly document and illustrate for the public exactly how Planned Parenthood harvests and sells aborted baby parts.”[41]

Facts:

Daleiden’s tactics are potentially criminal—not the actions of a responsible investigative journalist.

  • Daleiden never indicated he was a “journalist” until he released undercover videos and faced questions about the legality of his actions. Fox News reported that the tactics of Daleiden and his associates “would probably get them fired in most newsrooms.”[42]
  • Daleiden and his associates apparently filed official paperwork with the State of California to create a sham tissue procurement company called BioMax Procurement Services LLC.[43]
  • Daleiden and his associates apparently used fake identification to pose as representatives from BioMax—reportedly even going so far as to assume the identity of a former high school classmate of Daleiden’s.[44]
  • Daleiden secretly recorded Planned Parenthood personnel and other individuals over the course of three years without their consent and in possible violation of state invasion of privacy laws.[45]

Claim:

Planned Parenthood uses federal funds to provide abortions on demand.

  • “Planned Parenthood and their supporters in the media are willing to say anything to defend their taxpayer funded abortions and profiteering from selling aborted fetuses.”[46]

Facts:

Planned Parenthood does not use federal funds in this manner.

  • Since the 1980s, the Hyde Amendment has prevented federal funds from being used for abortions except in the case of rape, incest, or to save the mother’s life.[47]
  • Planned Parenthood uses Title X funding, a source of federal grants dedicated to family planning, to “subsidize birth control, STD screenings, and other reproductive health services for [uninsured] low-income patients.”[48]
  • As permitted under the Hyde Amendment, Planned Parenthood may use federal funds to cover abortions in the case of rape, incest, or to save the mother’s life.
  • Planned Parenthood uses federal funds to provide “critical health services, including annual wellness exams, cancer screenings, contraception, and to further the study of sexually-transmitted diseases.”[49]
  • Planned Parenthood receives private funding, which can be used to cover abortion services.[50]

Claim:

Most of the services Planned Parenthood provides are abortion related.

  • “Ninety-four percent of their business, 94 percent—94 percent is abortion services, their own numbers.”[51]
  • “In 2013, abortions made up 94 percent of Planned Parenthood’s so-called pregnancy services—94 percent.”[52]

Facts:

Abortion services make up a miniscule percentage of Planned Parenthood’s services.

  • Last year, the vast majority of Planned Parenthood’s services included treatment of sexually transmitted disease (42%), providing contraception (34%) and other women’s services (11%), and cancer screening (9%).[53]
  • Abortion services accounted for only 3% of the services that Planned Parenthood provided last year.
  • Planned Parenthood also “plays a big role” in providing information, counseling, and services related to general healthcare, adoption, body image, relationships, and sexual orientation and gender.[54]
  • During the 2013-2014 reporting year, Planned Parenthood provided 10,590,433 services to approximately 2.7 million people.[55]

Claim:

Planned Parenthood receives federal funding for fetal tissue donation programs.

  • “When it comes down to actual violations of the law, when people are using illegal abortion procedures in order to harvest and sell fetal tissue for profit, um, that’s something that most people find barbaric and that’s something that people don’t want to be funded by their tax payer dollars.”[56]

Facts:

No federal funds are used to support Planned Parenthood’s fetal tissue donation programs.

  • Although federal law permits HHS to fund or support human fetal tissue transplantation research, it “has not funded or conducted this specific type of research involving fetal tissue in recent years.”[57]
  • Funding provided to Planned Parenthood from HHS “does not support research involving fetal tissue.”[58]
  • The National Institutes of Health (NIH) and the Food and Drug Administration (FDA) are the only agencies that currently fund or conduct fetal tissue research.
  • NIH fetal tissue research only accounts for “less than 0.3% of [its] total research budget” and only a “tiny fraction of FDA’s total research budget.”[59]
  • Planned Parenthood does not receive any funding from NIH or FDA to provide abortion services or participate in fetal tissue research.

Claim:

Most Planned Parenthood affiliates participate in fetal tissue donation programs.

  • “We spent three years with our actors and investigators undercover deeply imbedded with Planned Parenthood, um, Planned Parenthood affiliates and top level executives. We’ve heard from their own mouths, many, many times over that they’re, that they sell the body parts and that they make money off of doing so and they have a profit motive in doing so.”[60]

Facts:

Only a small fraction of Planned Parenthood affiliates currently participate in fetal tissue research.

  • Currently, only two of Planned Parenthood’s 59 affiliates participate in fetal tissue research.[61]
  • Few women have the opportunity to donate fetal tissue to Planned Parenthood affiliates because “researchers have not requested tissue from the local affiliate or because the local affiliate has chosen not to participate.”[62]
  • Fetal tissue donation is not available at 99% of Planned Parenthood health centers.[63]

Claim:

If Congress defunds Planned Parenthood, women will still have access to the same healthcare services elsewhere.

  • “If Planned Parenthood’s federal funding ‘went awaytomorrow,’ Mattox [senior counsel at Alliance Defending Freedom] argues, the money ‘would be better used by community health centers and other places around the country that can provide a fuller range of services to women without the ethical challenges that Planned Parenthood presents.’”[64]

Facts:

Defunding Planned Parenthood would leave millions of women without access to critical and affordable healthcare services.

  • “More than half of Planned Parenthood’s health centers are in rural or medically underserved areas.”[65]
  • Planned Parenthood is the “sole source of medical care” for many women, particularly those living in rural communities.[66]
  • “In 18 states, Planned Parenthood health centers serve more than 40% of women obtaining contraceptive care from a safety-net family planning health center.”[67]
  • “Some community health centers provide assistance for low-income consumers, like Planned Parenthood, but not all do.”[68]
  • Since 2010, Congress has cut more than $31 million from Title X family planning funds. “A lot of communities lost the only providers they had” as a result of these “devastating cuts.”[69]
  • Remaining health clinics that serve low-income patients “haven’t been able to absorb the additional patients.”[70]
